Proper service gives the court authority over the parties. If service is defective, the case is vulnerable. This class walks step-by-step through initial service requirements, drafting service documents, appointing process servers, and properly serving pleadings to ensure your case begins—and continues—on solid procedural ground. Participants will learn Georgia’s personal service requirements, how to draft Acknowledgments of Service and Rule Nisi Notices (in contempt actions), and prepare Affidavits of Service by sheriff or special process server. The class also covers requesting appointment of a Special Process Server, including drafting the Motion, supporting Affidavit, and proposed Order. Because not every case involves simple hand-delivery, this session also addresses service outside Georgia, service by publication, and personal jurisdiction over non-residents. We will cover the motions, affidavits, and orders required to complete alternative service properly, as well as service in foreign order and UCCJEA matters. By the end of this class, you will understand how to complete service correctly in both routine and complex situations to avoid delay or dismissal.
