Custody cases require both a strong understanding of Georgia law and the ability to translate that law into clear, enforceable Parenting Plans. This class combines both components by teaching the legal framework governing custody determinations and the practical drafting skills necessary to prepare court-ready documents. We begin with custody fundamentals, including the distinction between legal and physical custody, the statutory best-interest factors under O.C.G.A. § 19-9-3(a), how courts evaluate parental conduct, stability, and involvement, and attorney’s fees considerations in custody disputes. We also address child election of custody, including when a child's preference may be considered and how to properly draft an Election Affidavit. Participants will learn what information must be included in custody pleadings and how to preserve requests for findings through a Request for Findings of Fact and Conclusions of Law, helping ensure the record is properly developed when appellate review becomes necessary. The second half of the class focuses on Parenting Plan drafting. Participants will learn how to draft clear, specific provisions governing parenting schedules, holidays and school breaks, decision-making authority, transportation and exchanges, communication expectations, and dispute-resolution procedures.
