This course examines the constitutional and statutory requirements governing visitation actions under O.C.G.A. § 19-7-3. Participants will learn who qualifies as a "family member," when an original action or intervention is permitted, and how to satisfy the statute's heightened clear and convincing evidence standard. The course covers proving harm to the child's health or welfare, developing evidence of a preexisting relationship, and connecting that evidence to the child's best interests. We also discuss standing, procedural limitations, filing restrictions, minimum visitation provisions, guardian ad litem appointments, mediation, and practical case management considerations. Participants will learn how to draft petitions and final orders that comply with statutory requirements and include the specific findings necessary to withstand appellate review. By the end of the class, you'll understand how to evaluate, prepare, litigate, and resolve grandparent and family member visitation cases with confidence.
