This course provides a practical guide to handling equitable caregiver actions under O.C.G.A. § 19-7-3.1. Participants will learn how to establish standing, prepare the required petition and supporting affidavit, and navigate the statute's two-step process from preliminary standing through final adjudication. The course examines each statutory element, the clear and convincing evidence standard, parental consent, and the evidence necessary to prove an equitable caregiver relationship and likely harm if that relationship is severed. We also discuss statutory limitations, temporary relief, custody and visitation following adjudication, attorney's fees, and recent appellate decisions interpreting the Act. By the end of the class, participants will understand how to evaluate equitable caregiver claims, develop supporting evidence, draft court-ready pleadings and proposed orders, and avoid the procedural pitfalls that can result in dismissal or reversal.
