This class walks through the procedural life cycle of a divorce case after it has already begun, equipping legal professionals to confidently enter, manage, amend, respond to, and close cases with precision. We begin with entering ongoing litigation, including drafting an Entry of Appearance and Substitution of Counsel, while addressing the strategic and procedural considerations involved when joining a case mid-stream. Next, we explore amending and supplementing pleadings. Participants will learn when amendments may be filed as a matter of right, when court approval is required, and how to draft amendments that add exhibits, revise factual allegations, replace existing pleadings, or supplement newly arising facts. We will also cover Motions to Supplement Pleadings and Orders Allowing Supplementation. The class then transitions to drafting an Answer and Counterclaim for Divorce, including preserving defenses, asserting counterclaims, and strategically framing issues involving equitable division, custody, alimony, and attorney’s fees. Finally, we focus on properly closing a case. Participants will learn how to prepare dismissals, Final Disposition Forms, Consents to Try, Motions for Judgment on the Pleadings, Petitioner’s Affidavits, proposed orders, Final Hearing Questions, and Reports of Divorce.
