Some of the most critical evidence in a family law case does not come from the opposing party—it comes from banks, employers, schools, medical providers, and other third parties. This class provides a structured approach to issuing discovery to non-parties, ensuring compliance with procedural rules and maximizing evidentiary impact. We begin with the framework for Discovery to Non-Parties, including when and why third-party discovery is necessary and how it differs from party discovery. Participants will learn how to obtain Testimony of Third Parties by Deposition, including drafting and issuing a Deposition Subpoena. The course then focuses on Subpoenaing Documents, including: • Preparing a Subpoena for Production of Documents • Drafting an accompanying Service Letter • Understanding timing, objections, and compliance requirements We will also address alternative document requests, including drafting a Request for Production of Documents to a Non-Party and preparing a professional and effective Cover Letter. Finally, we cover what to do when there is a Failure to Produce Documents, including enforcement options.
